Terms of service

EC Site Terms of Use
(Purpose)

These Terms of Use (hereinafter referred to as "these Terms") apply to the users (defined in Article 2) who use "KAGE JAPAN" (hereinafter referred to as the "Site") operated by KAGE Co., Ltd. (hereinafter referred to as the "Company") and to the sales contracts of products concluded using the Site. Users shall use the Site upon agreeing to these Terms, the "Privacy Policy," the "Display based on the Act on Specified Commercial Transactions," and the "About Orders, Delivery, and Returns."

These Terms stipulate the conditions of use for the Site. All users who have registered as users on the Site shall use the Site in accordance with these Terms, subject to conditions such as age and usage environment. If specific conditions are displayed on the product page, those conditions shall apply in conjunction with these Terms. If the content differs, the specific conditions clearly displayed before ordering shall prevail, unless contrary to law.

By agreeing to these Terms, a contract (defined in Article 2) is established between the user and the Company.

(Definitions)

The following terms used in these Terms shall have the meanings set forth in each of the following items.

  • "This Contract": refers to the contract for the use of the Site concluded between the Company and the user, with these Terms as the contract conditions.

  • "Sales Contract": refers to a contract concluded using the Site to order and purchase products.

  • "User": refers to all persons who have registered as users of the Site.

  • "Product": refers to the product purchased by the user using the Site.

  • "Made-to-order Product": refers to a product whose production starts after the order is placed.

  • "Semi-custom Product": refers to a product for which the user changes or specifies dimensions, color, material, design, and other specifications within the choices provided by the Company.

  • "Full-custom Product": refers to a product manufactured by individually determining specifications through discussion between the Company and the user.

  • "User ID, etc.": refers to the user's ID and password registered on the Site.

  • "Communication Devices": refers to smartphones, tablet devices, and computer equipment.

(Content of the Site)

By using the Site, the user can purchase the Product from the Company.

(User Registration)

A person who intends to become a user of the Site shall, after agreeing to the contents of these Terms, perform user registration by entering accurate and up-to-date information regarding the user's name, address, telephone number, and other information through the procedure specified by the Company. Minors, adult wards, persons under curatorship, and persons under assistance shall not be able to register as users if the setting and entry were not performed by a legal representative or if the prior consent of the legal representative was not obtained.

If a change occurs in the information registered based on the preceding paragraph, the user bears the obligation to immediately perform the procedure to change the registered information.

Even if the user suffers damages due to failing to change the registered information, the Company shall bear no responsibility whatsoever. If product confirmation, production, or delivery is delayed due to an error in the entered information or a lack of notification regarding a change in contact information, the Company may confirm the situation and guide the user on how to respond (including the details if additional shipping costs, etc. are incurred).

The Company may refuse user registration at its discretion.

The user may not allow a third party to use, lend, transfer, sell, or pledge the account on the Site.

(Order and Acceptance, Refusal of Acceptance, and Order Cancellation of the Product)

If the user wishes to purchase the Product, they shall order it in accordance with the method specified by the Company. The "Order Confirmation Email" automatically sent by the Company after the completion of the user's order procedure merely notifies the receipt of the order information, and the sales contract for the Product is not established by this email. After the Company confirms the order details, the availability of payment, the availability of delivery, and other necessary matters with the user, the sales contract for the Product is established upon the sending of the "Order Acceptance Email." Furthermore, the Company may change the specifications, etc., of the purchase procedure for the Product from time to time to improve the convenience of using the Site.

In particular, in cases exemplified below, the Company may process the cancellation of the user's order without notice and without accepting the user's order:

  • When there are errors, defects, or unnatural points in the order information

  • When the purchase quantity limit is exceeded

  • When procurement of materials, production, or delivery is difficult

  • When the specifications desired by the purchaser cannot be realized for safety or technical reasons

  • When delivery is not possible due to laws and regulations of the destination, import restrictions, or restrictions of the delivery company

  • When there is an obvious and serious display error in the product price or specifications

  • When prompt payment completion after the conclusion of the contract cannot be expected

  • When there has been non-payment of the price, refusal of receipt, or other serious breach of contract in the past

  • When there are other objective and reasonable circumstances that make it impossible to fulfill the order

Even after the conclusion of the sales contract in Paragraph 1, the Company may process the cancellation of its acceptance and the user's order due to the cases exemplified in Paragraph 2 or other unavoidable reasons.

The user shall also confirm and agree to "About Orders, Delivery, and Returns" regarding the Company's acceptance after the order, the cancellation process of the user's order, returns, and other conditions.

(Payment of the Price)

After the conclusion of the sales contract in the preceding article, the user shall pay the price for the Product in accordance with the method specified by the Company. Note that any fees related to the payment shall be borne by the user.

Payment methods, payment timing, and settlement conditions will be displayed in the "Display based on the Act on Specified Commercial Transactions," on the product page, and on the screen before the order is confirmed. The terms established by each settlement business operator may apply to the use of settlement services. We may ask you to provide additional information to prevent fraudulent use or to verify your identity. The Company will not request information that exceeds the scope necessary for the purpose.

In addition, the display of payment methods, payment timing, and settlement conditions in the "Display based on the Act on Specified Commercial Transactions," on the product page, and on the screen before the order is confirmed shall take precedence over these Terms. However, if there are non-existent or unclear parts in the display, the following shall apply:

  • The base currency is Japanese Yen (JPY). For overseas customers, it may be displayed and settled in local currency according to the settings of Shopify Markets, and the displayed price may fluctuate depending on exchange rates, etc.

  • Normal payment methods are credit card, Apple Pay, Google Pay, and Shop Pay, and settlement is generally made at the time of order.

  • Bank transfer and invoice payment will not be displayed on the normal EC settlement screen and will be handled individually if requested. The payment deadline shall be within 7 days after the guidance or invoice issuance, and the order will be confirmed and production will begin upon confirmation of payment. If payment cannot be confirmed within the deadline, the order may be canceled.

The Company will deliver the Product by a method specified by the Company after confirming the payment of the price by the user. Furthermore, if the Product is returned to the Company due to the user's refusal to receive it, long-term absence, or other reasons of the user after the Company has completed the delivery procedure for the Product, actual increased costs for transportation, etc., or a fee separately determined by the Company may be incurred for redelivering to the user, and the user agrees to this in advance.

(Transfer of Ownership and Risk Bearing)

The ownership and risk of the Product shall be transferred from the Company to the user at the time the delivery of the Product is completed.

(Shipping and Returns of the Product)

We do not accept returns or exchanges of the Product for the user's convenience after the order is completed.

For made-to-order products, upon completion, the Company will share photos of the completed product with the purchaser, and will ship it after the purchaser has confirmed and approved the color, specifications, decorations, and other contents.

If the purchaser confirms damage to the product at the time of arrival (or when there is damage or partial loss to the product that cannot be immediately discovered, and the purchaser notifies the carrier to that effect within two weeks after the arrival of the product), the purchaser or recipient shall not file a claim with the Company, but rather the purchaser or recipient themselves shall file a claim with the delivery company or the compensation insurance company. For overseas shipments, the purchaser themselves shall enroll in a compensation insurance company, and the purchaser shall bear the insurance premiums, shipping costs, etc.

In cases where there is a clear manufacturing defect or failure in the product, and the purchaser notifies the Company to that effect within 7 days after the arrival of the product, the Company will confirm the defect or failure, judge whether it can be repaired without an unreasonable burden, and respond by repairing, returning, or refunding. A clear manufacturing defect or failure of the product shall not include minor individual differences in color, shape, dimensions, weight, texture, pattern position, finish, etc., due to the manual work of artisans, individual differences in handicrafts normally expected, minor differences between the photo and the actual product, and changes in color gloss and texture over time.

Damages during wearing, using, or handling by the purchaser/recipient, etc., and defects or failures notified after 7 days have passed since the product arrived will be handled for a fee.

(Management regarding User ID, etc. and Communication Devices)

The user shall provide all the environments such as equipment, communication means, and transportation means necessary to receive the provision of the Site at their own expense and responsibility. In addition, all communication costs required for the use of the Site shall be borne by the user.

The user bears the responsibility for managing the User ID, etc., and communication devices. The user is responsible for any damage caused by inadequate management of the User ID, etc., and communication devices, errors in use, or use by a third party, and the Company shall bear no responsibility whatsoever unless the Company is intentional or negligent.

If there is a risk that the User ID, etc., or communication devices may be used by a third party, the user shall immediately notify the Company to that effect and comply with any instructions from the Company.

(Provision Conditions of the Site)

The Company may suspend or modify the Site without notifying users for maintenance or other reasons.

(Intellectual Property Rights, etc.)

Regardless of the method or form, the user may not copy, reproduce, publicly transmit, modify, or otherwise use any and all information and content provided on the Site (hereinafter collectively referred to as "Company Content") beyond the scope of private use defined in the Copyright Act.
